Platform Kullanımına İlişkin Genel Şartlar ve Koşullar

1. Genel Hükümler

Bu Kullanım Koşulları, www.cvfit.com.tr adresinde hizmet veren CVFit platformunun ("Platform") kullanımına ilişkin şartları düzenler. Platform, Okan Akarsu ("İşletmeci") tarafından işletilmektedir.

Platformu kullanarak bu koşulları kabul etmiş sayılırsınız. Kabul etmemeniz halinde Platformu kullanmamanız gerekmektedir.

2. Hizmet Tanımı

CVFit, yapay zeka teknolojileri kullanarak CV/özgeçmiş analizi ve optimizasyonu hizmeti sunan bir SaaS (Hizmet Olarak Yazılım) platformudur. Sunulan hizmetler şunlardır:

CV yükleme ve yapay zeka destekli analiz

CV içerik ve format optimizasyon önerileri

Sektörel uyumluluk değerlendirmesi

Abonelik kapsamında sunulan ek özellikler

3. Üyelik ve Hesap

3.1. Hesap Oluşturma

Platformu kullanmak için geçerli bir e-posta adresi ile kayıt olmanız gerekmektedir. Kayıt sırasında verdiğiniz bilgilerin doğru ve güncel olmasından siz sorumlusunuz.

3.2. Hesap Güvenliği

Hesap bilgilerinizin ve şifrenizin gizliliğinden siz sorumlusunuz. Hesabınız üzerinden gerçekleştirilen tüm işlemlerden siz sorumlu tutulursunuz. Yetkisiz kullanım tespit etmeniz halinde derhal bizimle iletişime geçmelisiniz.

3.3. Hesap Askıya Alma ve Fesih

İşletmeci, bu Kullanım Koşullarını ihlal eden hesapları önceden bildirimde bulunmaksızın askıya alma veya feshetme hakkını saklı tutar.

4. Abonelik ve Ödeme

4.1. Ücretlendirme

Platform, abonelik modeli ile çalışmaktadır. Güncel abonelik planları ve ücretleri Platform üzerinde yayımlanır. İşletmeci, fiyatlandırmada değişiklik yapma hakkını saklı tutar.

4.2. Ödeme

Ödemeler, Paddle ödeme altyapısı aracılığıyla kredi kartı ile gerçekleştirilir. Ödeme işlemleri Paddle'ın kendi hizmet şartlarına tabidir.

4.3. İptal ve İade

Aboneliğinizi istediğiniz zaman iptal edebilirsiniz. İptal halinde mevcut abonelik döneminizin sonuna kadar hizmetten faydalanmaya devam edebilirsiniz. İade politikası, 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve ilgili mevzuat hükümleri çerçevesinde uygulanır.

5. Fikri Mülkiyet Hakları

Platform üzerindeki tüm içerik, tasarım, yazılım, logo ve görseller İşletmeci'ye aittir ve fikri mülkiyet hakları ile korunmaktadır. Kullanıcılar tarafından yüklenen CV'lerin fikri mülkiyeti ilgili kullanıcıya aittir.

Kullanıcılar, yükledikleri CV'lerin yapay zeka ile analiz edilmesi ve işlenmesi için İşletmeci'ye sınırlı lisans vermektedir. Bu lisans yalnızca hizmet sunumu amacıyla kullanılır.

6. Kullanıcı Yükümlülükleri

Kullanıcılar aşağıdaki kurallara uymayı kabul eder:

Platformu yalnızca yasal amaçlarla kullanmak

Başkalarına ait kişisel verileri izinsiz yüklememek

Platformun güvenliğini tehlikeye atacak girişimlerde bulunmamak

Otomatik veri toplama araçları (bot, scraper vb.) kullanmamak

Platform üzerinden zararlı yazılım dağıtmamak

7. Sorumluluk Sınırlaması

Platform, yapay zeka destekli öneriler sunmakta olup bu öneriler tavsiye niteliğindedir. İşletmeci, CV analiz sonuçlarının kesinliğini veya iş başvurularında başarı garantisi vermez.

Platformun kesintisiz ve hatasız çalışacağı garanti edilmez. Teknik arızalar, bakım çalışmaları veya mücbir sebeplerden kaynaklanan erişim kesintilerinden İşletmeci sorumlu tutulamaz.

8. Uygulanacak Hukuk ve Uyuşmazlık Çözümü

Bu Kullanım Koşulları Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda Düzce Mahkemeleri ve İcra Daireleri yetkilidir.

9. Değişiklikler

İşletmeci, bu Kullanım Koşulları'nı önceden bildirimde bulunarak güncelleme hakkını saklı tutar. Güncellemeler Platform üzerinde yayımlandığı tarihte yürürlüğe girer.

General Terms and Conditions Governing Platform Usage

1. General Provisions

These Terms of Service govern the use of the CVFit platform ("Platform"), accessible at www.cvfit.com.tr. The Platform is operated by Okan Akarsu ("Operator").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Service Description

CVFit is a SaaS (Software as a Service) platform that provides AI-powered CV/resume analysis and optimization services. The services include:

CV upload and AI-powered analysis

CV content and format optimization recommendations

Industry compatibility assessment

Additional features available through subscription plans

3. Account Registration and Security

3.1. Account Creation

To use the Platform, you must register with a valid email address. You are responsible for ensuring that the information provided during registration is accurate and up to date.

3.2. Account Security

You are responsible for maintaining the confidentiality of your account credentials. All activities conducted through your account are your responsibility. You must notify us immediately if you suspect any unauthorized access.

3.3. Account Suspension and Termination

The Operator reserves the right to suspend or terminate accounts that violate these Terms without prior notice.

4. Subscription and Payment

4.1. Pricing

The Platform operates on a subscription model. Current subscription plans and pricing are published on the Platform. The Operator reserves the right to modify pricing with reasonable notice.

4.2. Payment

Payments are processed via Paddle payment infrastructure using credit cards. Payment transactions are subject to Paddle's own terms of service.

4.3. Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, you will retain access to the service until the end of your current billing period. Refund requests are handled in accordance with applicable consumer protection laws and our refund policy.

4.4. Free Trial and Credits

New users may receive a limited number of free analysis credits. Free credits are non-transferable and may expire. The Operator reserves the right to modify the free credit offering at any time.

5. Intellectual Property Rights

All content, design, software, logos, and visuals on the Platform are owned by the Operator and protected by intellectual property laws. The intellectual property of CVs uploaded by users remains with the respective user.

By uploading your CV, you grant the Operator a limited, non-exclusive license to process and analyze your CV using AI technology solely for the purpose of providing the service. This license terminates when you delete your account.

6. User Obligations

Users agree to comply with the following rules:

Use the Platform only for lawful purposes

Not upload personal data of others without their consent

Not attempt to compromise the security or integrity of the Platform

Not use automated data collection tools (bots, scrapers, etc.)

Not distribute malicious software through the Platform

Not reverse-engineer, decompile, or attempt to extract the source code of the Platform

7. Limitation of Liability

The Platform provides AI-powered recommendations that are advisory in nature. The Operator does not guarantee the accuracy of CV analysis results or success in job applications.

The Platform is provided on an "as is" and "as available" basis. The Operator does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

8. Indemnification

You agree to indemnify and hold harmless the Operator from any claims, losses, liabilities, damages, costs, and expenses arising from your use of the Platform or violation of these Terms.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey. For users in the European Union, mandatory consumer protection provisions of your country of residence shall apply to the extent required by law. Any disputes shall be resolved through the competent courts in Düzce, Turkey, without prejudice to mandatory consumer protection jurisdiction rules.

10. Changes to These Terms

The Operator reserves the right to update these Terms with prior notice. Updates take effect on the date they are published on the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
